The new code does not handle the PD as a SLU and eliminates the ability of the PD to be appealed by the ZBA. This means fighting it once approved automatically goes to circuit court. The existing one, as a SLU, has to meet the SLU standards and also could be appealed locally to your ZBA. Some communities make PD a rezoning, which is even better because it can go to referendum. You didn't have this before….but you also didn't have the prohibition that it couldn't be appealed to ZBA.
